Definitions

  • Client: The individual or entity requesting plumbing services.
  • Company: Liquid Force Plumbing.
  • Services: All plumbing-related tasks undertaken by the Company, including but not limited to installations, repairs, and maintenance.
  • Goods: Any materials or products supplied by the Company in the course of providing Services.

Scope of Work

We commit to delivering Services as outlined in our quotations or agreements. Any additional work or variations will be discussed and agreed upon in writing before commencement.

Quotations and Pricing

  • Validity: Quotations are valid for 30 days from the date of issue.
  • Inclusions: Prices include labor, materials, and any other specified costs.
  • Exclusions: Any unforeseen issues or additional work not specified in the original quotation may incur extra charges.

Payment Terms

  • Deposit: A deposit may be required before commencing work, as specified in the quotation.
  • Payment Due: Full payment is due upon completion of the Services, unless otherwise agreed in writing.
  • Late Payments: Overdue payments may attract interest at a rate of 2% per month.

Delivery of Goods and Services

  • Scheduling: We will make every effort to commence and complete the Services on the agreed dates. However, unforeseen circumstances may cause delays.
  • Access: The Client must provide clear and safe access to the premises. We are not liable for any delays or additional costs arising from restricted access.

Ownership and Risk

  • Risk: Risk in Goods passes to the Client upon delivery to the site.
  • Title: Ownership of Goods remains with the Company until full payment is received.

Warranties and Guarantees

  • Workmanship: We guarantee our workmanship for 12 months from the completion date.
  • Materials: Manufacturer warranties apply to all materials and products supplied.
  • Exclusions: Warranties do not cover misuse, neglect, or unauthorised modifications.

Variations and Additional Work

Any variations or additional work not included in the original agreement will be discussed and agreed upon in writing, including any impact on cost and completion time.

Liability and Indemnity

  • Limitation: Our liability is limited to the value of the Services provided. We are not liable for indirect or consequential losses.
  • Indemnity: The Client agrees to indemnify the Company against any claims arising from the Client’s breach of these Terms and Conditions.

Termination

Either party may terminate the agreement with written notice if the other party breaches a fundamental term of the agreement. The Client will be liable for any work completed up to the termination date.

Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through negotiation. If unsuccessful, mediation or arbitration may be pursued before considering legal action.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia. Any legal proceedings will be conducted in the relevant courts of Western Australia.

Privacy and Confidentiality

We respect your privacy and will handle your personal information in accordance with applicable privacy laws. Any confidential information shared during the provision of Services will remain confidential.

Force Majeure

We are not liable for any failure to perform our obligations due to events beyond our control, including natural disasters, pandemics, or other unforeseen events.

Entire Agreement

These Terms and Conditions, along with any written agreements or quotations, constitute the entire agreement between the Company and the Client, superseding any prior agreements or understandings.

Amendments

We reserve the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client in writing.
